This article is a review and reflection of the new elements of rights and laws, applied to the principle of justice and sovereignty, but above all in the demonstration that law as a science once again allows us to conceive that as a science it evolves and must be modified according to the new conducts that the State and society require, such is the case of the constitutional recognition that this type of rights have. In the last decades, human beings (...) have evidenced that the way in which they interact with nature is causing serious consequences to the ecosystems that compose it. In the past, these consequences were not yet evident and, therefore, the environmental awareness that exists today did not exist. Therefore, it is necessary to analyze and reflect on certain conditions of this right in Ecuador. (shrink)

The academic literature reveals the need to undertake more in-depth field studies in order to discover the organisational culture, the difficulties and the perceptions surrounding CSR in SMEs. This study presents the results of analysis of four case studies on Catalan companies that stand out for their social and environmental practices. The conclusions of this paper are the result of dialogue with the main actors – four medium-sized companies – focusing on their actions, understandings and resistance with regard to CSR. (...) The methodological perspective used was Grounded Theory, with the aim of the study being to contribute towards formalising CSR in SMEs, in their daily practices, by analysing some primary data. The results obtained show how difficult it is for SMEs to understand CSR, beyond the explanation of the specific practices carried out by the companies. They highlight the role played by the values of the founding director in the implementation of CSR programmes; they reveal that SMEs still have a long way to go towards learning how to inform both internal and external stakeholders of their best practices, and; finally, they show the interesting links that SMEs establish between responsible practices, improved competitiveness and economic results. Finally, the text points out the implications that the results of this analysis may have on creating ways of promoting CSR in SMEs. We believe that, in light of the opinions expressed by the companies, public organisations should try to concentrate on creating a favourable framework for responsible competitiveness, as a way to deal with CSR when addressing SMEs. In a globalizing world, governments are not always able or willing to regulate the social and environmental externalities of global business activities. Multi-stakeholder initiatives (MSI), defined as global institutions involving mainly corporations and civil society organizations, are one type of regulatory mechanism that tries to fill this gap by issuing soft law regulation. This conceptual paper examines the conditions of a legitimate transfer of regulatory power from traditional democratic nation-state processes to private regulatory schemes, such as MSIs. Democratic legitimacy is (...) typically concerned with input legitimacy (rule credibility, or the extent to which the regulations are perceived as justified) and output legitimacy (rule effectiveness, or the extent to which the rules effectively solve the issues). In this study, we identify MSI input legitimacy criteria (inclusion, procedural fairness, consensual orientation, and transparency) and those of MSI output legitimacy (rule coverage, efficacy, and enforcement), and discuss their implications for MSI democratic legitimacy. In this paper I propose an explanation for the impulsivity displayed by some of our emotional experiences. I begin by looking for such an account in the psychological and philosophical literatures. After expressing doubts regarding some approaches’ resources to account for the phenomenon at issue, I outline an account of emotional impulsivity by focusing on (1) its independence from judgment and deliberation; (2) its felt strength; and (3) its relationship to action. Following the intuition that there is a strong connection (...) between the possession of skills and the ability to entertain certain representational states, I propose that the impulsivity of some emotional experiences can be explained by their characteristic inseparability from sets of sensorimotor skills. This paper presents the results of a Catalan project in which an academic institution acted as a practitioner to promote corporate social responsibility (CSR) in small and medium-sized enterprises (SMEs). The project involved the establishment of a working network with intermediate organisations and the creation of specific tools for the purpose. The paper is set up as a case study, emphasising inclusion, representativity and legitimacy as key elements for the successful construction of a network to promote CSR in SMEs. It (...) underlines the assumptions behind the functioning of this network and the learning findings from this public–private initiative. Presented from a public policy perspective, the paper emphasises the need for coordination in terms of the growing number of initiatives fostering CSR in SMEs. It presents a brief account of the material results, focusing on the process of creating a consensus within the network. It opens up a path for future research, exploring how network management and leadership can be seen as key issues when talking about corporate social responsibility (CSR) promotion in SMEs. (shrink)

The current crisis has come at a cost not only for big business but also for business schools. Business schools have been deemed largely responsible for developing and teaching socially dysfunctional curricula that, if anything, has served to promote and accelerate the kind of ruthless behavior and lack of self-restraint and social irresponsibility among top executives that have been seen as causing the crisis. As a result, many calls have been made for business schools to accept their responsibilities as social (...) institutions and to work toward becoming more socially embedded and better attuned to public interests. In this paper, however, we point to some of the barriers there may be in the way of business schools developing into responsible organizational citizens proper. We argue that there are lines of resistance against responsibilization operating at epistemological, institutional, and organization levels and that we need to take account of barriers on all these levels in order to properly capture the challenges that are involved in making the modern business school amenable to demands for more social responsibility. In terms of working toward overcoming such barriers, we discuss how business education can become more socially embedded via the inclusion of ethical reflection and critical thinking. (shrink)

Para ello, se propone un análisis del consentimiento próximo a Le volontaire et l'involontaire, en el que se tiene siempre en la mira la hermenéutica del sí-mismo y del homo capax, desarrolladas por Ricoeur desde 1990. Se defiende que el consentimiento va siempre (...) acompañado de la paciencia, y que ambos pueden y deben ser pensados como elementos estructurales que constituyen al sí-mismo. By inquiring into the privilege granted by Paul Ricoeur to affirmation with respect to the multiple forms of negativity inscribed in human beings and their actions, the article seeks to contribute conceptual elements for a philosophy of consent. To this effect, it proposes an analysis of consent along the lines of Le volontaire et l'involontaire, bearing in mind the hermeneutics of self and of homo capax, developed by Ricoeur since 1990. The paper argues that consent goes hand in hand with patience, and that both can and should be thought as structural elements that constitute the oneself. En el presente artículo se hace un análisis del cuento “¡Tierra!”, de Pedro Gómez Valderrama, desde dos perspectivas: la de cuento histórico y la del erotismo. El análisis, que evalúa los aspectos históricos recreados por el autor en el relato, confronta las fuentes históricas que éste utiliza para la construcción de su cuento e intenta indagar en la posición desde la que se interpretan literariamente los hechos, en la cual el erotismo es fundamental. As corporations are going global, they are increasingly confronted with human rights challenges. As such, new ways to deal with human rights challenges in corporate operations must be developed as traditional governance mechanisms are not always able to tackle them. This article presents five different views on innovative solutions for the relationships between business and human rights that all build on empowerment, dialogue and constructive engagement. The different approaches highlight an emerging trend toward a more active role for corporations in (...) the protection of human rights. The first examines the need for enhanced dialogue between corporations and their stakeholders. The next three each examine a different facet of empowerment, a critical factor for the respect and protection of human rights: empowerment of the poor, of communities, and of consumers. The final one presents a case study of constructive corporate engagement in Myanmar (Burma). Altogether, these research projects provide insight into the complex relationships between corporate operations and human rights, by highlighting the importance of stakeholder dialogue and empowerment. All the five projects were presented during the Second Swiss Master Class in Corporate Social Responsibility, held in Lausanne, Switzerland on December 12, 2008. The audience for this conference, which examined business and human rights, was composed of researchers, governmental representatives, and business and non-governmental organization practitioners. This paper is a response to the opening of new lines of research on CSR and SMEs (Thompson & Smith, 1991; Spence, 1999; Moore & Smith, 2006; Spence, 2007). It seeks to explore the business case for CSR in this corporate segment. The paper, which is based on four case studies of medium-sized firms in the automotive sector, took the distinctive approach of trying to understand the nature of CSR-like activities developed not by best-in-class CSR-driven companies but by purely competitiveness-driven (...) firms. The case studies provide explicit evidence that the CSR activities of SMEs and the notion of social capital are interrelated, turning social capital into a powerful instrument to better explain what academic literature has called silent CSR practices . The analysis that follows questions some of the basic tenets that underpin the branch of business ethics that deals with the nature of SMEs' approach to CSR. Four basic concerns, which take the form of propositions for further research, serve as the basis for this analysis: a) A definition of CSR that includes most of the actions taken by all companies in the territory contributes no academic value to the discipline b) Any study of the motivation behind these CSR actions must reflect their essentially pragmatic nature. Actions are linked to social values but also, more importantly, to the nature of the competitive environment c) Business ethics must seek common ground with other more sociological disciplines if it is to explain the reasons behind this type of action d) Any study of this kind of practice requires a dual approach: a) normative when using tools developed by CSR; and b) descriptive and instrumental using the notion of social capital. En este artículo se ofrece una visión de la biología sintética alternativa a los planteamientos ingenieriles que marcan gran parte de la agenda de investigación del campo. Nuestro análisis se centra en enfoques, teóricos y experimentales, cuyo objetivo fundamental es la comprensión del fenómeno de la vida per se. Una revisión detallada de varios casos de implementación artificial, in vitro, de sistemas químicos ‘auto-productivos’ nos ayudará a reflexionar sobre el enorme reto que supone transformar una disciplina científica eminentemente descriptiva, como (...) la biología, en un proyecto que incluya y potencie líneas de investigación basadas en la idea de síntesis o fabricación. El reto es mayúsculo debido al carácter intrínsecamente metabólico de los sistemas biológicos, lo cual hace que nuestro empeño en controlarlos o en construirlos de novo sea mucho más dificultoso, forzándonos a desarrollar plataformas de intervención/implementación a nivel molecular que no pongan en compromiso esa inherente dimensión autónoma de lo vivo. We can communicate linguistic information by asserting sentences that are not explicitly about linguistic matters. Stalnaker offers a pragmatic account of this phenomenon. It is not clear that such an account is correct. In this article I offer an alternative account that does not rely on pragmatic mechanisms and which captures many of the insights in Stalnaker's theory of linguistic communication. The view is inspired by Barker's semantics of vague adjectives.

Cet article se veut une présentation des méthodes principales que nécessitent les études en géolinguistique, un vaste domaine de recherche consacré à l’analyse de la variation, du changement et de la diffusion linguistiques. Je présenterai d’abord les outils méthodologiques d’enquêtes de terrain indispensables à la constitution d’un corpus de matériaux oraux (et visuels) qui permettent des analyses géolinguistiques, dont également celles de type comparatif. Plusieurs de ces concepts pourraient être appliqués à d’autres disciplines des sciences humaines en raison de leur (...) caractère général. Ensuite, je montrerai quelles sont les méthodes cartographiques les plus appropriées pour présenter et représenter la variation géolinguistique. Des données de l’Atlas linguistique des variétés berbères du Rif (Lafkioui 2007) seront utilisées pour illustrer les méthodes examinées. (shrink)

El presente artículo busca interrogar al fenómeno de la apelación. Para ello, se examinará el vínculo entre fenomenología y apelación preguntándonos qué es preciso entender por la máxima husserliana que conmina a un retorno a las cosas mismas; en segundo lugar, intentaremos dilucidar cómo la obediencia crítica a la consigna fenomenológica ha supuesto una recomprensión de fenómeno al punto de transformar la consigna husserliana en un verdadero “retorno de las cosas mismas”. Finalmente, nos proponemos interrogar la apelación del fenómeno, a (...) partir del diálogo entre Marion y Romano. No solo intentaremos dilucidar cuál es la especificidad de la apelación, sino qué relación estricta hay entre fenómeno, particularmente insigne o saturado y apelación. (shrink)

Whether levonorgestrel taken as an emergency contraceptive has an abortifacient effect is a matter of great importance for Catholic bioethics. While many have argued that LNG-EC does not have a postovulatory effect, a recent literature review has convincingly established that inhibition of ovulation cannot account for all of the pregnancy reduction observed in clinical settings among those who take LNG-EC. This essay proposes a secondary mechanism of action of LNG-EC that is postovulatory but prefertilization; it argues that LNG-EC may act (...) in a contraceptive fashion by interfering with transport of the ovum to the site of fertilization in the timely fashion needed for reproductive success. While this mechanism of action cannot be established with the moral certitude required of these matters of life and death, further research may validate this mechanism beyond a reasonable doubt. Education moves in the space of distance between those who are coming into the world and the world that they arrive. Since Modern Age, this distance formed by the opposing subject and object, has tended to be an impassable abyss. In this way, the world unfolds in two: the world whose image under investigation in the field of Education is the blackboard, and the world of everyday life. In front of the blackboard the student is installed, constituted as a subject, (...) which should curtail the reality until it fits with the security and accuracy of mathematical world-object-blackboard. The world of ordinary life is there and education does not know what to deal with it, and have it for non-existent. The reality held by non-existent prevents people’s existential integration. But there’s another kind of Educations that integrates and includes subjective and objective world and needs the courage to accept and even demand the new perspectives of those who are coming to build a more complete and always risky world. Se argumenta que quienes adoptan estas nociones enfrentan serios problemas y se recomienda abandonarlas, lo que no quiere decir que no haya otra forma plausible de entender estos conceptos.

ABSTRACT In this paper I present and evaluate Leibniz’s two main arguments against the existence of atoms. In this context atoms are extended particles that are absolutely hard, homogeneous, indivisible, and indestructible by natural means. As we shall see, Leibniz’s arguments are flawed in a very instructive way. The first argument is in tension with the claim that God created the best possible world. The second argument overgeneralizes in an undesirable way. However, as I shall discuss in the last section (...) of the paper, even if the arguments are somehow defective, at least the first one contributes valuable insights to contemporary metaphysics. John Dewey (1859-1952) es reconocido por dar continuidad al legado de las primeras elaboraciones del pragmatismo de Charles Pierce y Williams James y a su vez por desarrollar su propio análisis sobre la dimensión social y política de este movimiento filosófico, aporte que sustenta las contribuciones a otros campos del saber y de manera especial a la pedagogía. La reflexión sobre la educación representa un asunto central en el pensamiento del filósofo estadounidense, desde el desarrollo teórico reflejado en su prolífica (...) obra clasificada como pedagógica y en su actividad política en el movimiento progresista. La doble arista de la vida de Dewey es coherente con uno de los principios pedagógicos promulgados por él: la unión indisociable entre la dimensión moral e intelectual en la formación humana a través de la experiencia, aspecto que fundamenta su crítica a la educación tradicional de su tiempo, la cual propende por el desarrollo de capacidades intelectuales hacia un fin último (apropiación de asignaturas escolares o preceptos morales), fenómeno que se evidencia en la imagen del ciclo escolar como proceso que prepara al niño para la vida adulta por encima, o mejor, a pesar de su experiencia presente. El análisis sobre dicha relación es tratado ampliamente en el texto Moral Principles in Education, publicado por primera vez por Dewey en 1909 bajo el auspicio de la firma Houghton Mifflin Company, de ee uu., y difundido en 2008 en su versión electrónica por el Proyecto Gutenberg, de donde se extraen los fragmentos originales que en esta edición se traducen al español. Por las razones señaladas, se considera fundamental para la filosofía de la educación contemporánea la difusión de la citada obra en lengua castellana, por la vigencia de sus planteamientos en la reflexión del papel de la escuela, pero sobre todo de la educación, en la formación moral del sujeto, no como un asunto del futuro ciudadano, sino como un aspecto inherente a la vida escolar cotidiana. A long‐standing debate in the study of human communication centers on the degree to which communicators tune their communicative signals (e.g., speech, gestures) for specific addressees, as opposed to taking a neutral or egocentric perspective. This tuning, called recipient design, is known to occur under special conditions (e.g., when errors in communication need to be corrected), but several researchers have argued that it is not an intrinsic feature of human communication, because that would be computationally too demanding. In this study, (...) we contribute to this debate by studying a simple communicative behavior, communicative pointing, under conditions of successful (error‐free) communication. Using an information‐theoretic measure, called legibility, we present evidence of recipient design in communicative pointing. The legibility effect is present early in the movement, suggesting that it is an intrinsic part of the communicative plan. Moreover, it is reliable only from the viewpoint of the addressee, suggesting that the motor plan is tuned to the addressee. These findings suggest that recipient design is an intrinsic feature of human communication. (shrink)
